Terms of Use

The agreement between you, your workspace and us for using Swift.

Last updated 3 October 2026

Agreement

These terms are an agreement between you and [COMPANY NAME] ("we", "us") for using the Swift web app, mobile app and in-store kiosk ("Swift"). By creating an account or using Swift you accept them. If you use Swift for a business, you confirm you may accept these terms on its behalf.

Our Privacy Policy explains how we handle personal information and forms part of these terms.

Early access

Swift is currently offered as invite-only early access. Features may change, and we may add, change or remove functionality. We will give reasonable notice before introducing fees; you will not be charged without agreeing first.

Accounts and workspaces

  • Give accurate information and keep your sign-in details secret. You are responsible for activity on your account.
  • A workspace owner controls the workspace: who can join, their roles and permissions, and its content. Owners and permitted managers can suspend or offboard members.
  • Ownership can be transferred to another active member. An owner must transfer ownership before deleting their account while other members remain.
  • Tell us promptly if you believe your account has been compromised.

Your content

Workspaces own the content they put into Swift. You give us permission to host, process and display that content only as needed to provide Swift to you and your workspace.

Each workspace is responsible for having a lawful basis to record its customers' and staff's personal information in Swift, including at an in-store kiosk, and for responding to requests from those people.

Acceptable use

Do not:

  • break the law or infringe anyone's rights;
  • upload malware, or content that is abusive, harassing or unlawful;
  • try to access workspaces, accounts or data you are not authorised to use;
  • probe, overload or disrupt Swift, or get around its security or rate limits;
  • resell or provide Swift to others without our written permission.

Suspension and ending

You can stop using Swift and delete your account at any time in Settings → Security.

We may suspend or end access if you seriously or repeatedly breach these terms, or if needed to protect Swift or its users. Where reasonable we will tell you first and give you a chance to fix the problem.

Availability

We work to keep Swift available and secure, but during early access it is provided without a guaranteed uptime, and there may be interruptions for maintenance or reasons outside our control. Keep your own copies of anything you cannot afford to lose.

Liability

To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of profit, revenue or data, arising from your use of Swift. Our total liability is limited to the amount you paid us for Swift in the 12 months before the claim, or R1,000 if you paid nothing.

Nothing in these terms limits rights you have under the Consumer Protection Act, 2008 or other law that cannot be excluded, or our liability for gross negligence or wilful misconduct.

Changes and governing law

We may update these terms. For material changes we will notify you in the app before they take effect; continuing to use Swift afterwards means you accept them.

These terms are governed by the laws of the Republic of South Africa, and South African courts have jurisdiction.
